1.1 These Terms and Conditions (the "Terms") govern your access to and use of the Grocera GbR event ticketing platform, website, mobile applications, and related services (collectively, the "Platform"). By accessing or using the Platform, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree to these Terms, you are not authorized to use the Platform.
1.2 These Terms constitute a legally binding agreement between you and Grocera GbR (registered at Andernacherstr. 16, 80993, Munich, Germany), ("we," "us," or "our").
1.3 We may modify these Terms from time to time. We will post any changes on the Platform and, where appropriate, notify you via email or through a notification on the Platform. Your continued use of the Platform after the posting of changes constitutes your acceptance of the revised Terms.
2.1 Grocera GbR provides a platform that enables event organizers ("Organizers") to create, promote, and sell tickets to events. We also allow users to discover, purchase tickets for, and attend events.
2.2 We are not the organizer of the events listed on the Platform. We only provide the platform for Organizers to manage their events and sell tickets.
2.3 The Organizers are solely responsible for all aspects of their events, including but not limited to the event description, content, venue, safety, execution, and cancellation.
3.1 To use certain features of the Platform, you may be required to register an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.2 You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account.
3.3 You agree to notify us immediately of any unauthorized access to or use of your account.
3.4 We reserve the right to suspend or terminate your account if we believe that you have violated these Terms or that your account has been compromised.
4.1 When you purchase a ticket through the Platform, you are entering into a direct agreement with the Organizer of the event.
4.2 Ticket prices are set by the Organizer and may be subject to additional fees, such as service fees and booking fees, which will be clearly displayed before you complete your purchase.
4.3 Payment for tickets must be made through the payment methods accepted on the Platform.
4.4 You authorize us or our third-party payment processor to charge your selected payment method for the total amount of your ticket purchase, including any applicable fees.
4.5 All sales are final unless otherwise stated in the event description or required by law.
4.6 Tickets are typically delivered electronically. You are responsible for ensuring that you have a valid email address and access to your email account to receive your tickets.
5.1 Event cancellations and refunds are subject to the Organizer's policies, which are typically stated on the event page.
5.2 Grocera GbR is not responsible for event cancellations or postponements. In the event of a cancellation, we will use reasonable efforts to facilitate communication between you and the Organizer regarding refunds.
5.3 If the Organizer authorizes a refund, the refund will be processed through the payment method you used to purchase the ticket. Refund processing times may vary.
5.4 Service fees and booking fees may not be refundable, depending on the Organizer's policy and applicable laws.
5.5 Certain events may have specific refund policies outlined on the event page. It is your responsibility to review these policies before purchasing a ticket.
By purchasing a ticket through the Platform, you may receive promotional emails from Grocera, a leading online grocery delivery service, to the email address you provided.
You have the right to unsubscribe from these promotional emails at any time by clicking the "unsubscribe" button located at the bottom of each email.

7.1 You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the Platform.

8.1 The Platform and all content, trademarks, logos, and other intellectual property displayed on the Platform are owned by Grocera GbR or its licensors.
8.2 You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial use.
8.3 You may not copy, reproduce, modify, distribute, or create derivative works of any content on the Platform without our express written permission.
9.1 THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PLATFORM, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.2 WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9.3 WE ARE NOT RESPONSIBLE FOR THE ACTIONS OR OMISSIONS OF ORGANIZERS OR OTHER USERS OF THE PLATFORM.
10.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GROCERA GBR SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR USE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.2 OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE TICKET(S) IN QUESTION.
You agree to indemnify and hold harmless Grocera GbR, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any rights of another person or entity.
12.1 These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles.
12.2 Any dispute arising out of or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the German Institution of Arbitration (DIS) in Munich, Germany. The decision of the arbitrator shall be final and binding on both parties.
We may terminate your access to the Platform at any time, with or without cause, and with or without notice.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between you and Grocera GbR relating to your use of the Platform and supersede all prior or contemporaneous communications and proposals, whether oral or written.
